Privacy, security, confidentiality and great customer service are important to Garden Trading Retail. The following terms and conditions endeavour to make our web site a safe and easy place to shop.

You should understand that by using this web site you agree to the following terms and conditions.

General

Your contract is with Garden Trading Retail Limited ("GTR") of Unit 1a/1b Carterton South Ind Est, Carterton, Oxon, OX18 3EZ

You agree that e-mail will be used as the standard means of communication. If your order is accepted, we will send you an e-mail confirming this. This confirmation e-mail will contain all relevant statutory information concerning your contract.

GTR do not store credit card information. We do not sell our customer's details, however we are a member of Abacus Alliance, which is a data co-operative where companies share transactional and postal address details in order to refine the preferences of people already on the Abacus database.

If your details are not already on the Abacus database then they will not be added as a result of ordering from Garden Trading.

If you do not wish us to do this please select the box on the address page of the checkout and we will make sure your details are not made available in this way. We will not share your email address or telephone number with any third party.

When you create an account we will sign you up to our e-newsletters, but you can unsubscribe from these at any time by clicking the link in the email.

As of the 18th of February 2010, GTR use Sage Pay for online credit and debit clearing, in conjunction with Barclays Bank. As a result of this change, we now charge for the order in full at the time the order is placed. Therefore please ensure if you are pre-ordering an item that you are happy to pay for it in advance.

You undertake that all details which you provide to us for the purpose of ordering goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the order.

Your statutory rights are not affected but otherwise all purchases are non-exchangeable, non-refundable and non-transferable.

All prices on this site include United Kingdom VAT at the prevailing rate.

Discount Codes

If you have a discount code, then it must be entered into the voucher code box in 'your cart',and must be done so at time of ordering. You must be logged in to your account in order to use a discount code. We will not be able to apply a discount code to an order after it has been processed, and no refunds will be given.

If you wish to apply a discount code to an item that you have on back order with the order will need to be placed again, (and postage paid again) as we are unable to put a discount onto an order that we have already received and charged for.

PLEASE NOTE- YOU NEED TO CREATE AN ACCOUNT AND BE LOGGED-IN IN ORDER TO USE A DISCOUNT VOUCHER.

Emails and Catalogues

It is optional when you place an order that you enter a password in order for your details to be stored for next time. Whether you create an account, or put the order through without saving your details, we will add you onto our catalogue mailing list and our e-newletter list. If you would like to opt out of receiving catalogues or emails then please email enquiries@gardentrading.co.uk

Delivery

GTR aims to deliver all orders within 7 working days of confirmation that your order has been accepted, but during busy periods delivery may take slightly longer.

A statutory cooling off period of 7 days applies to all orders in accordance with The Consumer Protection (Distance Selling) Regulations 2000.

DELIVERY INSTRUCTIONS
By specifying a place that you would like the courier to leave the parcel without a signature - you are accepting liability if the parcel goes missing after being left in the place you have specified, and we will not be able compensate you for this. If you are concerned that there is not a safe place then please give a delivery address where someone will be in to accept the delivery.

Standard Items
Our postage and packing charge for standard items for deliveries within UK mainland is £5.95 per order. Postage and packing of standard items to Northern & Southern Ireland, Channel Islands, Scottish Isles and other surrounding islands is £14.95. This postage rate also applies to BFPO addresses.

Bulky/Fragile Items
A small amount of items which are do not need to be delivered on a pallet, but which are bulky or fragile have a postage surcharge and cost £9.95 for delivery within UK mainland, and £19.95 for delivery to Northern and Southern Ireland, Channel Islands, Scottish Isles and other surrounding islands. This will be stated in the item description.

Very Large/Furniture Items
For very large furniture items, the delivery charge to UK mainland is £19.95, and this will be stated in the item description. Quotations for postage of these larger items to addresses outside of UK mainland are available upon request. GTR will not accept liability for courier delays.

If you do require next day delivery, or saturday delivery please call us on 0845 6084448 before 1:00pm and we can advise you of availability and cost. Calls cost 2p per minute during the daytime from a BT landine, other networks may vary. We can also offer timed deliveries, please call for details.

Failed deliveries
If an item is held at the post office awaiting collection and it is not subsequently collected, or if a delivery is refused and then returned to us - then a £6.50 charge will apply for the cost of returning the parcel to us.

Returns

Cooling off period

In accordance with the Distance Selling Regulation 2000 you have a cooling off period of 7 working days in which to cancel your order. We hope that you will be delighted with your goods, but please remember that if you decide within the first seven working days of receipt that the goods are not to your satisfaction you may return them to us. All we ask is that you return the goods in their original packaging and condition.

How to return or exchange items

  • Email enquiries@gardentrading.co.uk stating your reason for return and whether you would like an exchange or refund. In the case of a damaged product, please do send over an image where possible for us to pass on to quality control.
  • Under the Sale of Goods Act 1979, you may be entitled to a refund or replacement where goods are faulty or not as described. If the item is damaged or faulty, then we will cover the cost of receiving the item back with us. Please ensure that if you are sending anything back to us that you request a proof of postage, as we will not be liable for items lost in transit on their way back to us without proof of postage.
  • If you wish to return an item which is not damaged or faulty, then you can return the item for a refund or exchange, but this is done at your own cost and original postage paid will not be refunded. We are able to arrange for a courier collection on your behalf at a charge of £6.50 per box, but someone will need to be in all day to accept the parcel as we can not offer a specific time for collection. Failed collections will be chargable at £6.50 per box if we arrange a collection for you and no-one is in at the address.
  • If you requested a replacement item, this will be sent free of Post & Packaging charges.
  • If you have requested a refund, this will be processed within 21 days of receipt of your returned items. If this refund is made directly to your credit card this should appear on your next credit card statement.
  • Please note that refunds for items bought as gifts can only be given to the original purchaser and if you decide to swap an item we can not stop the payer from knowing.
  • If you have returned an item, we ask that you allow up to 14 working days for the item to be received back with us and be processed by our returns department, before you query the return.
  • Please be advised that if an item is returned to us after our returns period has ended, and without advising us first, then we reserve the right to charge a 10% re-stocking fee for the item
  • Please note - if you have a query or problem with an item that you have bought through one of our stockists, then you need to contact them directly.
  • Courier Collections-please ensure that you understand when placing an order, that if something is wrong and you need to return it then our courier does not offer timed or weekend collections, and someone needs to be in when the collection takes place.


Our Guarantee

Stock Permitting, all orders are dispatched within to arrive with customers within 7 working days. In the event that an item is out of stock, we will notify you of the delay and despatch it as soon as it arrives.

Every care has been taken to ensure that the descriptions and specifications are correct at the time of going to press. However, while the colour reproduction is a close representation, a very slight variation in the actual goods may occur, and all sizes are approximate. If it is essential that the mesaurements are accurate on an item then please contact us prior to ordering and we will be happy to help. We will not be liable for the cost of returning items that are not the right size for your purposes if you have not checked with us beforehand.

This is in addition to your statutory rights.

Backorders

If an item is out of stock at the time of ordering, then we will either wait for the whole order to be in stock so we may ship all together, or if there will be an extended delay then we may ship a partial order, with the balance to follow. We reserve the right to make the decision on whether to split the order or not, but you do have the option of paying two lots of carriage so that available items may be shipped straight away.

APPROXIMATE DUE DATES WILL BE SHOWN ON PRODUCTS BUT THESE ARE SUBJECT TO CHANGE. THEREFORE, PLEASE ENSURE THAT IF YOU PRE-ORDER AN ITEM YOU ARE HAPPY TO PAY FOR IT AT THE TIME AND THEN WAIT FOR IT TO COME INTO STOCK.

Once a back order comes into stock, we will send the item out automatically, so if you change your mind about an item that you have pre-ordered, then it is your responsibilty to cancel the order.

If a back-order is older than 3 months, we will contact the customer to ask if goods are still required and inform of expected delivery date, if available, at this time if goods are not required the back-order items will be cancelled.

Please note – this only applies to orders taken from customers on UK Mainland, all other destinations, due to delivery costs, we will not operate a back-order system.

Law

Every purchase you make shall be deemed performed in England. These Terms and Conditions shall be governed, construed and interpreted in accordance with the laws of England and Wales.

Additional

These terms and conditions contain the entire agreement between you and GTR relating to your purchase. You are responsible for reading all information in these terms and conditions fully. If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain.

Variations

We may amend these terms and conditions from time to time. All purchases from the date of posting onwards will be governed by that new version.

Liability

  • GTR attempts to ensure that the information available on the website at any one time is true and accurate but cannot guarantee that it will be error-free. GTC does not make any warranty that the website is free from infection by viruses, trojans, worms or anything else that may have destructive properties.
  • GTR does not accept liability for any errors and omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
  • GTR will do its best to correct errors and omissions as quickly as practicable after being notified of them.
  • GTR makes no representations about the fitness for a particular purpose of any of the products or services available on this website.
  • GTR does not accept liability for any indirect or consequential loss arising out of the use of the website or for any products or services purchased from the website.
  • GTR will only be liable for direct loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product or service purchased in respect of any claim.
  • This Liability section applies only to the extent permitted by law.

Customs

If your delivery address is outside the United Kingdom, you may be subject to import duties and/or taxes. You understand that any and all charges of this nature will be borne by you.

GTR may supply a Customs Label containing a brief description, and a valuation of the parcel's contents.
